Disney World Tragedy: Essential Lesson for Travelers with Allergies

Disney is facing a lawsuit after a New York physician tragically died from a fatal allergic reaction during a visit to Disney World last fall. The incident took place at Disney Springs, where the physician and their family dined at a restaurant that assured them it could accommodate severe food allergies. Despite their precautions, the physician suffered a severe reaction, resulting in their collapse and subsequent death at a nearby hospital. The family has since filed a lawsuit alleging negligence on the part of Disney and the restaurant, seeking $50,000 in damages and a jury trial.

In response to the lawsuit, Disney has sought to move the case to private arbitration, arguing that the terms and conditions of a Disney+ account that Piccolo agreed to years ago require arbitration for all disputes, even those unrelated to the Disney+ service. Piccolo's legal team disputes this, asserting that the terms do not apply to the wrongful death case and that the case should be heard by a jury. The legal battle will continue in a Florida court in October, where a judge will decide whether the case will proceed to arbitration or trial.
